The offence took place at around 1:50am, with the man refusing to stop smoking.
Police allege the man became aggressive when confronted by staff.
Police were called and escorted the man from the train.
“XPT staff are now quick to notify police of unruly behaviour,” Cootamundra Crime Manger Detective Inspector Paul Huxtable said.
“There is no room for negotiation and the passengers are taken from the train,” he continued.
